1. These Terms and Conditions

These Terms and Conditions apply to all transactions on this site. Please read them carefully. They do not affect your statutory rights.

We may change these Terms and Conditions at any time. Any changes will take effect on the date they are posted onto the site. These conditions are dated from 6th September 2004. You will need to read and accept the Terms and Conditions each time you place an order, to ensure that you are familiar with the most current ones.


2. Prices and Payment

All prices and charges on this site are shown in UK pounds sterling. They include any VAT payable, but exclude delivery charges (for details see 'Shipping and Handling' below).

The total cost of your order will be the price of the products you order, any additional services you choose plus the delivery charge. All these are clearly set out in your shopping basket. Prices, offers and products are subject to availability and may change before (but not after) we accept your order. If something becomes unavailable we may offer you an alternative or place your order on back order (for details see 'Back Orders' below).

We try very hard to ensure that all the information on this site is accurate, However, just occasionally, an error can occur. If we discover an error in the price or description of a product you have ordered, we will tell you and ask you whether you wish to continue with the order or cancel it.

We accept Visa, MasterCard, Delta, Switch and American Express cards as payment for contract phones (phones with a monthly price plan/tariff). We accept Visa, MasterCard, Delta, Switch, American Express, Solo, Electron and JCB cards for purchases that don't include contract phones. We do not charge for any item until it is ready to ship. Back ordered items are not charged until they are shipped.


3. Making A Purchase

Making a purchase could not be easier. Just browse our store, and add any items that you wish to buy into the shopping basket. After you have finished your selection, click on 'Checkout' and you will be asked for some details that we need to enable us to complete the order.

You will be asked to accept these Terms and Conditions before you are able to submit your order. If you don't accept these Terms and Conditions then we won't be able to accept your order.

We will send you three emails:

  1. The first email is a confirmation and receipt of your order. It does not indicate that a contract exists between us. This email will include an order reference number.

  2. We will send you a second email once your order has been processed and accepted. This will indicate acceptance of your order, and hence a contract between us.

  3. A third email will be sent as soon as your goods are dispatched. This will include your order reference and a delivery reference. Your delivery will include our invoice which also includes VAT details.

If your order includes a contract phone (phones with a monthly price plan/tariff) then you will be subject to a credit check. We supply this information to the network supplier you have chosen and they will carry out the check and verify your identity with a credit reference agency. The agency will supply the network with information from your credit file and the electoral register. The agency will keep a record of the search whether your application is successful or not (for further details please also see 'Terms and Conditions for Network Suppliers' below).

ultramobiles.co.uk does not have access to your credit check information. If you are declined for any reason then we will be unable to give you the reason for this. You will be able to send a letter requesting information from the network supplier you have chosen (please see 'Terms and Conditions for Network Suppliers' below for the relevant address contact details). In these instances we will send you the contact details within an email.

Both ultramobiles.co.uk and the network supplier you have chosen will also use your information to set-up and manage your account and to keep you up to date about new products and services by post, email and to your handset (you can always send an email to contact@ultramobiles.co.uk or simply write to customer services if you'd prefer not to receive marketing information).

A full explanation of how we will use Your Information can be found within our Privacy Notice and also in addition within the relevant network section (please see 'Terms and Conditions for Network Suppliers' below). By proceeding you are giving us your consent to the use of your information.

  • Terms for 3 Services only covers the terms on which you may use our Services. They don't cover your purchase of your Handset.

  • Additional terms can also be seen in the Price Guide (which is on our website and included with your handset). There may also be terms stated within our Services on your handset and in other documents about our Services (e.g. the User Guide and List of Services)

  • You must pay Charges as set out in your Price Plan.

You may end your connection to our Services within 14 days based on our 14-Day Money Back Guarantee terms (even if you've started to use our Services)

  • OPTION A: If you have chosen a 12 month price plan (e.g. Video Talk or Text & Talk), then the following applies:
    If you want to end your connection within the first 12 months (other than during the 14 day money back period), you will have to pay the cancellation fee for Price Plan. This is because the price plan you have selected is for 12 months. After the 12 months, you can finish the agreement at any time by giving 30 days notice. Your agreement then finishes when your next billing period ends.

  • OPTION B: If you have chosen a price plan which has no minimum term (eg3toGo), then the following applies:
    If you want your to end your connection (other than during the 14 day money back period), you need to give 30 days notice. Your agreement then finishes when your next billing period ends.
    ALL CUSTOMERS

  • We'll provide our Services within 3's network area but it's always possible that the quality or coverage may be affected at times.

  • You must not use our Services for any illegal or improper purposes. Anyone under 18 isn’t permitted to access our Age Restricted Services. If you don’t pay your account on time or we reasonably believe that you haven’t complied with certain terms of your agreement, we may suspend or disconnect our Services, but you still must pay all outstanding Charges (including a Cancellation Fee for disconnection).
    Note: When we say 'we' or 'our', we mean Hutchison 3G UK Limited, trading as '3'. Our registered number is 03885486 (England and Wales) and our registered office is at 9 Queen Street, Mayfair, London W1J 5PE.

4. Shipping And Handling

Where we Deliver
Delivery must be to the address at which your payment card is registered and must be within the United Kingdom (this excludes the Channel Islands). All mobile phone deliveries, accessories over £50 and parcels too large to fit through your letter box, must be signed for. Please make sure you keep the invoice that is enclosed with your goods.

Delivery Charges
We make every effort to keep our delivery charges as low as possible. Our charge depends on the type of product ordered. You only pay one delivery charge, irrespective of the number of products ordered. If you order two or more products which fall into different categories, the higher charge applies:

Mobile phones
Next day before midday - £1.95
Next day before 9am - £9.95

Please note that first class post is not available for these products.

Accessories
Next day before midday - £1.95
Next day before 9am - £9.95
First class post - £1.45

For example, if you buy a mobile phone and some accessories then you only pay either £1.95 or £9.95 depending on which service you select.

When you add products to your Shopping Basket, the appropriate charge will be added automatically. You will always be able to see this charge before submitting your order.

How we Deliver
All our products are delivered by the Royal Mail. Very occasionally we may dispatch your goods for delivery by other couriers. This maybe in circumstances where we feel our delivery service to you maybe compromised, instances such as industrial disputes and service level agreements not being fulfilled (local or national) within the Royal Mail. We reserve the right to change our delivery service without prior notice.

Next Day Delivery
We guarantee to dispatch all accepted orders placed by 6pm the same day for next day delivery, Monday to Friday. Orders placed after 6pm on a Friday will be dispatched on a Monday for next day delivery on a Tuesday. The Royal Mail do not guarantee deliveries on a Saturday but they endeavour to do so. We will provide you with a unique postal reference number should you wish to track your order on the Royal Mail website www.royalmail.co.uk

If you are out a card will be left through the letterbox where arrangements for collection can be made.

First Class Post
We guarantee to dispatch all accepted orders placed by 6pm the same day for delivery as per the standard Royal Mail first class delivery service.

IMPORTANT: We will do everything we can to meet the delivery times specified in this section. However, occasionally delivery times may be affected by factors beyond our control and therefore they cannot always be guaranteed. We will inform you if we become aware of an unexpected delay by email.

Please allow extra time for deliveries to Scottish Islands.

Missing, Damaged or Incorrect Orders
We try very hard to ensure that you receive your order in pristine condition. If you do not receive all your products, please check the despatch note included within the shipment to ensure the goods have been dispatched separately. If this is not the case then you can email us at deliveries@ultramobiles.co.uk or telephone Customer Services on 0870 950 3292.

In the unlikely event that a product arrives damaged or faulty, please follow the instructions in the delivery documents.


5. Back Orders

If your item is not in stock, we will place the item on order for you. Where items are out of stock, in most instances, the delivery will take an extra 24 hours on top of our normal delivery times. Should the delay take any longer than this then we will inform you by email where you may cancel your order should you not wish to wait.

If you don't inform us of your wish to cancel we will assume that you are happy with us placing the item on back order. You will of course have the right to cancel at anytime.


6. Tax Charges

For orders made from the UK, 17.5% VAT is added and is clearly shown within the shopping basket.


7. Credit Card Security

We are confident about the transaction security we offer on our site and that's why we back every purchase with a security guarantee. Our secure-server software encrypts all your personal information including credit or debit card number and name and address. The encryption process takes the characters you enter and converts them into bits of code that are then securely transmitted over the Internet.

In the event of unauthorised use of your credit or debit card, most banks and card issuers either cover all the charges or may limit your liability.

If your bank or card issuer holds you liable, ultramobiles.co.uk will cover your liability up to £50.00 provided that the unauthorised use of your credit or debit card resulted through no fault of your own from purchases made at ultramobiles.co.uk while using the secure server.

A Few Important Notes: this guarantee only applies to credit or debit card purchases made using ultramobiles.co.uk's secure server. This guarantee covers a maximum liability of £50.00. In the event of unauthorised use of your credit or debit card, you must notify your card provider in accordance with its reporting rules and procedures.

10. Returns Policy

14 Day Money Back GuaranteeIf you're not entirely satisfied with your purchase, for whatever reason, you can make arrangements to return it within a period of 14 days. All you need to do is call us direct on 0870 950 3292 and we will discuss the process over the phone with you. Your rights to return goods are protected under the EU Distance Selling Directive which can be found at http://www.hmso.gov.uk/si/si2000/20002334.htm

Faulty Goods
The following are guidelines. Wherever possible we will respond to your individual circumstances.

We guarantee products for a period of 1 year.

If you product is faulty and it is within the first 28 days of purchase then we will be happy to exchange this for you. All you need to do is call us 0870 950 3292.

To qualify for an exchange the product must be:

  • in otherwise "as new" condition; and
  • complete with any accessories and free gifts offered with it (and, if possible, the original box and packaging).

If your product is faulty and it is more than 28 days since the date of purchase you will need to have it repaired. Please call us on 0870 950 3292 where we can make arrangements for this.

11. Lowest Prices Guarantee

We'll give you 100% of the difference back if you can find the same product and offer cheaper on another UK registered company website or retail store.

We will only do this if the offer is available to purchase from stock either at the time of purchase or within 7 days of your purchase from ultramobiles.co.uk. You will need to present your receipt where you have already purchased.

We will not do this for opening, closing down, ex-display, clearance, re-furbished, special order, members only or extended warranty prices.

We will check the websites of our key competitors everyday to try and ensure we give you the best prices and value available.


12. Price Protection Guarantee

This commitment to you provides you with the confidence that should we lower our prices within 7 days of your purchase you can apply for a credit to the same value. Simply write to or e-mail us and we will raise a credit to this value.


 
13. Insurance

3 Months Free Insurance Option

This insurance policy, underwritten by a leading insurer, runs for a minimum of twelve months to ensure full protection for the term of your mobile phone contract and covers you from the moment you purchase the phone. This policy covers 3G phones.

You will receive the first three months insurance free, thereafter the monthly premium of £5.99 will be collected by direct debit. You need to take no action to take advantage of this offer. To guarantee immediate protection from the moment of purchase you have agreed that we send your personal and bank details to Sheraton Services, the Administrator of the Insurance Program.

Terms

The Direct Debit collection dates and full terms and conditions will be shown on your Evidence of Insurance. If, after 14 days of purchasing the phone, you have not received your Evidence of Insurance, please contact the Administrator on 01789 451713

Note: If the Administrator is unable to set up the Direct Debit instruction with your bank, or you cancel within the first three months, your policy will be cancelled immediately. Once cancelled the policy cannot be reinstated.

Policy number
Your policy number will be shown on your Evidence of Insurance but until this has been received, you should use your mobile phone number for all correspondence.

 

14. General

We, our Group companies and our suppliers own the copyright, trademarks and all other intellectual property rights in all material and content on this website, which you may use, download, copy, publish, transmit or otherwise make available by any other means only for your own personal, non-commercial use. Any other use or reproduction of the material or content is strictly prohibited.

You may not create any link to this website without the prior written consent, nor may you restrict or inhibit the use or enjoyment of it by anyone else.

These Terms and Conditions and all transactions relating to this website are governed by English Law and are subject to the non-exclusive jurisdiction of the English courts. We do not accept amendments to these terms and conditions.

Your data protection rights are set out in our Privacy Policy.

Additional terms and conditions may also apply for prize competitions, pre-release orders and our added value services and offers. If so, you will be alerted to them at the relevant juncture.
